This is intended behavior for Activity Mode to be sure the user knows their current activity is not being recorded. So long as you have an active track log recording, this menu will not appear.
You can configure [Setup > Recording > Autostart = On] to achieve this behavior every time the GPSr is powered on!
This is not so much a bug but rather a potential feature request for users that do not like the behavior.
